Federal Judge Mandates Release of Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the judge noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
