Canada’s food safety authority stated it intends to begin a “complete depopulation” of hundreds of these large birds at a farm following the supreme court refused to halt the disputed cull.

Judicial Obstacles Removed by Supreme Court Decision

The recent judicial decision removed any legal impediment to commencing the killings.

Universal Ostrich Farms, situated near the community of Edgewood, was first ordered in the month of May to cull nearly 400 birds, due to fears of an spread of H5N1 avian flu.

Earlier this week, officials seized control of the operation.

Sixty-nine birds have already died after the emergence of a flu-like illness.

Midweek, the nation’s top court issued an interim stay on the eradication directive as it considered whether to hear the case.

Governmental and Societal Reactions

The increasing controversy over the birds – and a simmering distrust of government – have motivated protesters to descend on the farm, with many expressing their anger on social media.

The situation has also penetrated Canada’s federal politics.

Earlier this fall, the opposition leader, the Tory leader, was asked repeatedly by reporters whether he backed the demonstrators.

The Conservative figure has avoided making specific comments on the matter, despite many within his party protesting against the slaughter.

He informed the press the situation had been poorly handled from the start but avoided mentioning the word “ostrich”.

International Interest and Proposals

A number of prominent individuals from the United States have petitioned authorities in Canada.

The American health chief proposed to relocate the ostriches to his ranch in Florida.

An American billionaire has also appealed with the authorities to rescind its eradication directive.

Health and Moral Arguments

The Canadian federal government said the relevant agency was following a “stamping out” approach in order to contain the spread of avian flu, a step in line with wider guidance from global health organizations.

However, animal rights organizations have called on the authority to perform additional tests on the animals to verify they are infected.

The ranch operators claimed that because the last bird flu death occurred on 15 January 2025, with the surviving majority seeming healthy or recovered, the flock has developed at least partial herd immunity against the virus.

They have also cast doubt on the extent and reliability of testing on the birds.

Ranch Spokesperson Reaction

On Thursday, the ranch representative, told the press that the agency was “murdering” healthy birds.

“They are prehistoric animals that have survived eons, but they won’t survive the government agency,” she said.

A co-owner said he was concerned there’s – in my opinion – there’s no justice left”.

Court and Authority Decisions

A national court, however, found that permitting the ostriches to stay alive could lead to the transmission of avian influenza to other animals, the livestock sector – or to humans.

The agency has not announced when it expects to begin culling the birds.

Culling Procedures

A 2016 agency manual, acquired under public access laws, states ostriches can be euthanized by different means, the preferred being lethal injection, which requires multiple individuals: one to hold the bird by restraining it, another to secure the head, and one to inject the drug.

Personnel can also use gas or neck dislocation.

Members of the organization can only shoot the ostriches “as a last resort”, if they have a “skilled marksman” on the premises.
